Terms of service

The website https://luxarmonie.com/ (hereinafter "the Site") is operated by MT MANAGEMENT SAS (hereinafter "Luxarmonie" or "we"). Any access to the Site and any purchase implies full, complete and unreserved acceptance of these General Terms and Conditions of Sale and Use (hereinafter "GTC").

These GTC constitute the sole foundation of the commercial relationship between MT MANAGEMENT and its customers. They prevail over any other document, save for particular conditions agreed upon in writing.

 

Article 1 — Scope of Application

These GTC govern all sales of products made on luxarmonie.com, intended for individual consumers (B2C) and professionals (B2B), regardless of their country of residence.

In the event of any contradiction between these GTC and particular conditions agreed upon in writing with a professional, the particular conditions shall prevail solely with respect to the contrary stipulations.

The GTC applicable to an order are those in force at the date of validation of said order. MT MANAGEMENT reserves the right to amend them at any time; such amendments shall not affect orders already placed and confirmed.

 

Article 2 — Products

MT MANAGEMENT markets, under the Luxarmonie brand, lighting fixtures and decorative objects, manufactured in partner workshops and warehouses located in Europe (notably in Poland) and Asia.

The photographs, visuals and product descriptions are presented as faithfully as possible. Slight variations in colour or rendering may occur depending on the display settings of your screen. Such minor variations do not constitute a defect of conformity and do not entitle the customer to a refund or exchange, save where they are objectively significant.

Certain products offer customisation options (colour, size, finish, engraving, or any other parameter specified at the time of order). These products are made to order in accordance with the customer's specifications.

 

Article 3 — Prices and Display

3.1 All-inclusive price — no hidden charges

The prices displayed on the Site are the final prices. For customers located within the European Union, they include all applicable taxes (VAT). For customers located outside the European Union, the displayed price includes all applicable taxes, customs duties and import charges at destination: Luxarmonie delivers under DDP (Delivered Duty Paid) terms. The customer shall not face any additional charges upon receipt of their parcel, regardless of the destination.

Delivery is complimentary on all orders placed on the Site, with no minimum spend, save where explicitly indicated otherwise during the checkout process.

3.2 Modification of prices

MT MANAGEMENT reserves the right to amend its prices at any time. The applicable price is that displayed at the time of definitive validation of the order by the customer.

3.3 Promotions and reference prices — Omnibus Directive

In accordance with Directive (EU) 2019/2161 known as the "Omnibus" Directive, transposed into French law by Order No. 2021-1734 of 22 December 2021 and its implementing decree, any reference price (strikethrough price) displayed on the Site corresponds to the lowest price applied by Luxarmonie during the 30 calendar days preceding the application of the reduction. This rule applies to all promotions, flash sales, commercial operations and promotional codes.

Only one promotional code may be used per order, unless explicitly stated otherwise. Codes are for single use per customer, unless otherwise indicated.

3.4 Pricing errors

In the event of a manifest pricing error (typographical error, technical anomaly rendering a price aberrant), MT MANAGEMENT reserves the right to cancel the order concerned. The customer shall be informed immediately and refunded in full within 14 calendar days where payment has already been made.

 

Article 4 — Order

4.1 Ordering process

The order is placed online by the customer through the Site's checkout process (adding to basket, entering information, choosing delivery, validating payment). The order shall only be definitively formed once payment has been confirmed by the relevant financial institution.

A confirmation email summarising the order is sent to the customer immediately upon validation. This email constitutes the acknowledgement of receipt of the order within the meaning of Article L221-14 of the French Consumer Code. It includes: the summary of products ordered, the total price, the delivery arrangements, the GTC in force, and a reminder of the cancellation form.

4.2 Product availability

Products are offered subject to availability of stock or the production capacities of our partner workshops. In the event of unavailability identified following validation of the order, MT MANAGEMENT shall inform the customer by email as promptly as possible and shall proceed with a full refund within 14 calendar days.

4.3 Refusal of orders

MT MANAGEMENT reserves the right to refuse or cancel any order in the event of serious suspicion of fraud, established abusive conduct, manifest pricing error, or breach of these GTC. The customer shall be informed and refunded in full where payment has been made.

 

Article 5 — Payment

Payment is due in full upon ordering. The accepted means of payment are as follows:

      Bank card: Visa, Mastercard, CB

      PayPal

      Apple Pay and Google Pay

      Klarna (instalment payment, subject to eligibility)

Transactions are secured through the payment providers integrated within Shopify, all PCI-DSS certified (Payment Card Industry Data Security Standard). Bank card data is transmitted directly between the customer and the payment provider, encrypted via SSL/TLS protocol. At no point does MT MANAGEMENT have access to the customer's complete banking details.

In the event of payment refusal by the customer's banking institution, the order is automatically cancelled. MT MANAGEMENT cannot be held liable for such a refusal.

For Klarna: eligibility conditions and the applicable annual percentage rate (APR) are presented directly during the payment process. Credit commits the customer and must be repaid. Verify your repayment capacity before accepting.

 

Article 6 — Delivery

6.1 Delivery zones

Luxarmonie delivers to numerous countries throughout the world. The available destinations are indicated during the ordering process.

6.2 Delivery times

The estimated delivery time is indicated on each product page. This period runs from the confirmation of payment. It varies depending on the product ordered and the country of destination, and may range from 24 hours to 6 weeks. The time indicated on the product page constitutes the priority contractual reference.

In the event of an overrun of the contractual delivery period by more than 7 working days without justification of force majeure, the customer may request cancellation of the order and obtain a full refund of the sums paid, in accordance with Article L216-2 of the French Consumer Code.

6.3 Carriers

MT MANAGEMENT engages several logistics providers depending on the geographical zones (PostNL, DHL, DPD, and local partner carriers). The tracking number is communicated by email upon dispatch.

6.4 All-inclusive price — DDP terms

Luxarmonie delivers exclusively under DDP (Delivered Duty Paid) terms across all of its markets. The price paid at the time of order is the definitive and total price, including all applicable taxes, customs duties and import charges in the country of destination. No additional charge shall be requested from the customer upon receipt of their parcel.

MT MANAGEMENT assumes responsibility for customs handling and discharges, depending on the markets and amounts, the applicable duties and taxes. This commitment to pricing transparency is a foundation of the Luxarmonie purchasing experience.

6.5 Transfer of risks

The transfer of risks of loss or damage to the product occurs at the moment of physical delivery to the customer or to the person designated by them at the delivery address. In the event of a parcel damaged upon receipt, the customer is invited to: (i) issue reservations to the carrier, (ii) photograph the parcel before opening, (iii) contact Luxarmonie within 48 hours at contact@luxarmonie.com with photographs and order number.

6.6 Delivery issues

In the event of a lost parcel, non-delivery beyond the estimated time, or delivery to an incorrect address, please contact us without delay at contact@luxarmonie.com specifying your order number. We shall initiate an investigation with the carrier and, depending on the outcome, proceed with a redelivery or a full refund.

 

Article 7 — Right of Cancellation

7.1 Statutory period and commercial extension

In accordance with Article L221-18 of the French Consumer Code and Directive 2011/83/EU, the consumer benefits from a period of 14 calendar days from physical receipt of the product to exercise their right of cancellation, without having to justify their decision or bear any penalties.

As a commercial gesture, Luxarmonie offers an extended period of 30 calendar days from receipt, namely 16 additional days beyond the statutory minimum.

7.2 Procedures for exercising the right

To exercise this right, the customer must notify their decision to MT MANAGEMENT before expiry of the applicable period, by:

The date of dispatch of the notification shall serve as proof of compliance with the period, regardless of the date of receipt by MT MANAGEMENT.

7.3 Return charges borne by Luxarmonie

Return charges are borne in full by Luxarmonie. A prepaid return label is provided once the cancellation request has been validated. The customer pays no charges in advance.

7.4 Refund

MT MANAGEMENT shall proceed with the refund within a maximum period of 14 calendar days from receipt of the returned product, or from proof of dispatch if earlier. The refund is made using the same means of payment as that used at the time of purchase, save with the express agreement of the customer for an alternative means. No charges shall be deducted from the refund.

 

Article 8 — Exclusions from the Right of Cancellation

In accordance with Article L221-28 of the French Consumer Code, the right of cancellation does not apply to:

      Products made to the consumer's specifications or distinctly personalised: choice of a specific colour, bespoke size, engraving, custom finish, or any other customisation option selected by the customer at the time of order

      Products unsealed after delivery which cannot be returned for reasons of hygiene or health protection

 

⚠ Imperative exception: Should a personalised product present a manufacturing defect, a material flaw, or non-conformity with the order placed (incorrect reference, colour different from that ordered, product damaged in dispatch), the customer may request its return, exchange or full refund, with no limitation linked to the personalisation. MT MANAGEMENT shall bear all return charges in such cases.

 

Article 9 — Statutory Guarantees

9.1 Statutory guarantee of conformity (Articles L217-1 to L217-29 of the French Consumer Code — 2022 reform)

MT MANAGEMENT is required to deliver products that conform to the contract and is liable for defects of conformity existing at the time of delivery or arising within a period of 2 years from the delivery of the new item.

In the event of a defect of conformity established within this period:

      The consumer may choose between repair or replacement of the product, subject to the cost conditions provided for in Art. L217-9

      Should remedying the defect prove impossible or fail to occur within a period of 30 days, the consumer may obtain a full refund or a price reduction

      The consumer is exempt from providing proof of the defect during the first 24 months following delivery (statutory presumption of pre-existence of the defect)

      Any item repaired under the statutory guarantee of conformity benefits from an additional 6-month extension of the guarantee

This guarantee applies at no charge to the consumer (labour, parts, return included).

9.2 Guarantee against latent defects (Articles 1641 to 1649 of the French Civil Code)

MT MANAGEMENT is liable for latent defects in the product sold which render it unfit for its intended use, or which so diminish such use that the purchaser would not have acquired it, or would have given a lower price for it, had they been aware of them. In the event of an established latent defect, the consumer may choose between:

      Returning the product and receiving a refund of the price (rescissory action)

      Retaining the product and receiving a partial refund of the price (estimatory action)

9.3 Applicable legal texts

Art. L217-4 French Consumer Code: "The seller delivers an item in conformity with the contract and is liable for any defects of conformity existing at the time of delivery."

Art. L217-12 French Consumer Code: "Any action arising from a defect of conformity shall be barred two years after delivery of the item."

Art. L217-13 French Consumer Code: "Any item repaired under the statutory guarantee of conformity benefits from an extension of this guarantee of six months."

Art. 1641 French Civil Code: "The seller is bound by a warranty on account of latent defects in the item sold which render it unfit for the use for which it is intended, or which so diminish such use that the purchaser would not have acquired it, or would have given a lower price for it, had they been aware of them."

Article 10 — Liability of MT MANAGEMENT

The liability of MT MANAGEMENT may only be engaged in the event of proven fault directly attributable to the company. It is limited, to the extent permitted by applicable law, to the amount of the order in dispute.

MT MANAGEMENT shall not be held liable for indirect damages (loss of business, loss of profits, commercial prejudice) arising from the use of its products.

These limitations do not apply: (i) to bodily injury caused by the products, (ii) to cases of established wilful misconduct or gross negligence on the part of MT MANAGEMENT, (iii) to the imperative statutory rights of consumers guaranteed by the legislation applicable in their country of residence.

MT MANAGEMENT shall not be held liable for any failures resulting from a force majeure event within the meaning of Article 1218 of the French Civil Code (natural disaster, pandemic, general transport strike, unforeseeable governmental decision, etc.).

 

Article 11 — Intellectual Property

All elements of the Site (texts, images, product visuals, atmospheric photographs, graphics, logo, structure, source code, set designs) are the exclusive property of MT MANAGEMENT or are subject to a licence granted to MT MANAGEMENT. They are protected by the French Intellectual Property Code (Articles L111-1 et seq.) and by international conventions.

Any reproduction, representation, extraction, modification, publication or commercial use, in whole or in part, of these contents without the prior written authorisation of MT MANAGEMENT is strictly prohibited and constitutes an act of counterfeiting punishable under Articles L335-2 et seq. of the French Intellectual Property Code (up to 3 years' imprisonment and a fine of €300,000).

 

Article 12 — Use of the Site

Access to the Site is reserved for natural persons of legal age or for legally constituted legal entities. Any use of the Site for unlawful, fraudulent purposes or contrary to these GTC is strictly prohibited.

MT MANAGEMENT reserves the right to suspend or terminate a user's access to the Site in the event of abusive, fraudulent conduct or conduct contrary to these GTC.

MT MANAGEMENT implements reasonable measures to ensure the security and availability of the Site, but does not guarantee uninterrupted or error-free access. The Site may be temporarily inaccessible for maintenance reasons.

 

Article 13 — Waste Electrical and Electronic Equipment (WEEE)

The lighting fixtures marketed by Luxarmonie are Electrical and Electronic Equipment (EEE) subject to European Directive 2012/19/EU on WEEE, transposed into French law.

MT MANAGEMENT contributes financially to an approved eco-organisation for the collection and recycling of end-of-life lighting fixtures. Lighting fixtures bearing the crossed-out wheelie bin symbol must not be disposed of with ordinary household waste. They must be deposited at an authorised waste collection centre or an approved WEEE collection point.

 

Article 14 — Personal Data Protection

MT MANAGEMENT processes customers' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. The procedures for collection, processing, retention and the rights of data subjects are detailed in our Privacy Policy, accessible from the footer of the Site.

Article 15 — Mediation and Dispute Resolution

15.1 Customer service — mandatory prior step

In the event of a dispute relating to an order or to the application of these GTC, the customer is invited to contact, in the first instance, the Luxarmonie customer service:

MT MANAGEMENT undertakes to acknowledge receipt within 48 working hours and to provide a complete response within a period of 15 calendar days. Should there be no amicable resolution within 60 days from the first written complaint, the customer may resort to the alternative solutions set out below.

15.2 European Online Dispute Resolution (ODR) Platform

In accordance with Regulation (EU) No. 524/2013, the European Commission provides an online dispute resolution platform accessible at:

Article 16 — Applicable Law and Competent Jurisdiction

These GTC are governed by French law. Pursuant to Regulation (EC) No. 593/2008 known as "Rome I" and Regulation (EC) No. 44/2001 known as "Brussels I", consumers residing in a Member State of the European Union benefit from the imperative consumer protection provisions in force in their country of residence, even where the GTC provide for the application of French law. MT MANAGEMENT may not invoke these GTC to deprive a consumer of statutory protections to which they are entitled under the law of their country of residence.

In the event of a dispute not resolved amicably, the competent courts of Paris (France) shall have exclusive jurisdiction, subject to the imperative rules of jurisdiction applicable to consumers in their country of residence within the EU.

 

Article 17 — Miscellaneous Provisions

17.1 Severability

Should any of the provisions of these GTC be declared null or inapplicable by a competent court, the remaining provisions shall remain in force to the fullest extent permitted by law.

17.2 Non-waiver

The fact that MT MANAGEMENT does not avail itself, at a given moment, of any one of the clauses of these GTC may not be construed as a waiver of its right to subsequently avail itself of that same clause.

17.3 Entire agreement

These GTC constitute the entire agreement between MT MANAGEMENT and the customer concerning their subject matter, and supersede any prior oral or written agreement.
